FAIR HOUSING

All recipients and sub-recipients of CoC Program and ESG Program funding must comply with the non-discrimination and equal opportunity provisions of Federal civil rights laws as specified at 24 C.F.R. 5.105(a), including, but not limited to the following:

  • Fair Housing Act
  • Section 504 of the Rehabilitation Act
  • Title VI of the Civil Rights Act
  • Title II of the Americans with Disabilities Act
  • HUD’s Equal Access Rule

AFFIRMATIVELY FURTHERING FAIR HOUSING

CoC Member Agencies must have non-discrimination policies in place and conduct assertive outreach to people least likely to engage in the homeless system. Organizations receiving CoC Program and ESG Program funding shall market housing and supportive services to eligible persons regardless of race, color, national origin, religion, sex, age, familial status, or disability; and, shall provide program applicants and participants with information of their rights and remedies under applicable federal, state, and local fair housing and civil rights laws.

Treasure Coast Homeless Services Council Continuum of Care (CoC) projects must comply will all local, state and federal laws regarding fair housing and housing accessibility, occupancy, and resident selection procedures, including, but not limited to, the Fair Housing Act, Americans with Disabilities Act of 1990, Rehabilitation Act of 1973, the Fair Housing Accessibility Guidelines, and the accessibility requirement of the 2003 International Building Code, Chapter 11.

All CoC member agencies must not discriminate on the basis of age, color, sex, religion, national origin, handicap, disability, sexual orientation or familial status.

The CoC is required to affirmatively market all housing and supportive services to eligible persons regardless of race, color, national origin, religion, sex, age, familial status, or disability who are least likely to apply in the absence of special outreach. Housing assisted by HUD and made available through the CoC must also be made available to individuals and families without regard to actual or perceived sexual orientation, gender identity, or marital status in accordance with 24 CFR 5.105 (a)(2).

In the marketing of CoC housing opportunities, all advertising, brochures, leaflets and other printed materials must include the Equal Housing Opportunity statement, or statement and logo, all signs, on or off-site, will prominently display the statement, or statement and logo, and HUD’s Fair Housing Poster must be displayed on site in a conspicuous place.

Individual agency policies pertaining to affirmatively furthering fair housing may not be used in lieu of this policy; rather they should be used in conjunction with this CoC mandated policy.

Treasure Coast Homeless Services Council CoC ensures that persons with disabilities have equal access to services through compliance with the requirements of Title II and Title III of the Americans with Disabilities Act. Treasure Coast Homeless Services Council CoC does not discriminate against individuals with disabilities on the basis of disability in the CoC’s services, programs or activities.
